These terms apply to everything you do on this website and to every order you place with Photo Portfolio ("we", "us", "Photo Portfolio"), based in Trinidad and Tobago. By creating an account, requesting a quotation or placing an order you agree to them. Please read them together with our Privacy Policy and Shipping & Returns page.
1. Who we are
Photo Portfolio
2. How ordering works
Our prints are made to order. The process is:
- You choose a photograph, size, material and frame and send us an order request. An order request is an enquiry; it is not a contract and no payment is taken at this stage.
- We review your request and send you a quotation with the final price, any delivery or collection charge and applicable tax. Standard prices shown on the website are a guide only and may differ from a quotation, for example for custom sizes or delivery to a remote area.
- A quotation is valid for 14 days unless it states otherwise. You accept it through your account. Acceptance forms a binding contract for the goods and prices quoted.
- We confirm your payment and begin production. We will keep you informed of progress in your account.
We may decline or cancel a request, for example if a photograph cannot be reproduced at the requested size to a quality we are happy to put our name to. If we cancel after you have paid, we refund what you paid for that item.
3. Prices and tax
Prices are shown in USD. Where Value Added Tax (VAT) applies, it is shown on your quotation and invoice. We correct pricing errors before you accept a quotation; if an error is found afterwards we will contact you and you may cancel without charge.
4. Payment
Payment methods and instructions are given on your quotation (for example bank transfer or in person). Production starts once we have confirmed that payment has been received. We do not store card details on this website. Orders that remain unpaid after the quotation expires may be cancelled.
5. Production, colour and quality
Each print is produced from the original photograph with care. Colours on a screen differ from colours on paper, and slight variation between prints is normal. We check that each photograph has enough resolution for the size you choose and will tell you if a size is not suitable. Limited-edition prints are numbered and the edition size is stated on the artwork page.
6. Delivery and collection
See Shipping & Returns. Delivery dates are estimates. Risk in the goods passes to you when they are delivered to, or collected by, you or a person you nominate.
7. Cancellation, changes and returns
Because every print is made specifically for you, you may cancel or change an order only before production has started. After that, we cannot accept a return for a change of mind, but we will always put right a print that is faulty, damaged or not as ordered, as set out in Shipping & Returns. Nothing in these terms removes any right you have as a consumer under the laws of Trinidad and Tobago, including the Consumer Protection and Safety Act and the Sale of Goods Act.
8. Copyright and permitted use
All photographs, text and designs on this website are protected by copyright under the laws of Trinidad and Tobago and remain the property of the photographer. When you buy a print you own that physical print. You do not acquire the copyright or any licence to copy, publish, display publicly for commercial purposes, resell or reproduce the image, including in digital form, without our written permission. Images on this website, including low-resolution previews, may not be copied or used by others.
9. Your account
You are responsible for keeping your password confidential and for activity on your account. Please give us accurate contact and delivery details. We may suspend an account that is used abusively or unlawfully.
10. Website use
Please use the website lawfully and do not attempt to disrupt it, scrape it at scale, or gain access to areas you are not authorised to use. We try to keep the website available and accurate but do not promise it will be uninterrupted or error-free.
11. Our responsibility
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our negligence. We do not exclude or limit liability where the law does not allow it. Subject to that, we are not liable for indirect or consequential loss, and our total liability for any order is limited to the price you paid for it.
12. Events outside our control
We are not liable for delay or failure caused by events beyond our reasonable control, such as severe weather, supplier or courier disruption, power or internet outages, or industrial action. We will tell you promptly and agree a new date or, if the delay is long, refund what you have paid for undelivered goods.
13. Changes to these terms
We may update these terms. The version that applies to an order is the one published when you accepted its quotation.
14. Governing law
These terms are governed by the laws of the Republic of Trinidad and Tobago, and the courts of Trinidad and Tobago have jurisdiction, without affecting any right you have to bring a claim where you live.
